1. The agreement

These terms govern your use of Serverpacemaker, a software product of Job Done Marketing LLC ("we," "us," "the company"). By purchasing or using the software, you agree to these terms.

2. License grant

When you purchase Serverpacemaker, we grant you a non-exclusive, non-transferable, perpetual license to:

  • Install the binary on one (1) server that you own or operate
  • Run the binary on that server for any purpose, commercial or personal
  • Make backup copies of the binary for the same server

3. License restrictions

You may not:

  • Install the binary on more than one server without purchasing additional licenses
  • Redistribute, sublicense, rent, or sell the binary to others
  • Reverse-engineer, decompile, or disassemble the binary, except where permitted by applicable law
  • Remove or alter copyright notices in the binary
  • Use the binary to build a competing product

4. Fleet and volume licensing

If you need to run Serverpacemaker on multiple servers, contact us at sales@serverpacemaker.com to discuss fleet pricing.

5. Refund policy

If Serverpacemaker doesn't work for your use case within 14 days of purchase, email sales@serverpacemaker.com and we'll refund the purchase. No questions asked, no forms to fill out. We'd rather have an honest relationship than a forced sale.

6. Updates

Your license includes all updates to the Serverpacemaker v6 series. When a new version is released, we'll email you a download link. Installing updates is optional — you can stay on your current version indefinitely.

6a. Reactivation policy

Each purchase includes three (3) free reactivations within the first twelve (12) months from the date of purchase. A reactivation is required when the software must be activated on a different server, for any reason. Reactivations are granted at our discretion upon receipt of proof of purchase (typically a copy of the Stripe receipt).

After three reactivations, or after twelve months from the date of purchase, a new license is required to install the software on a different server, regardless of the reason for the reactivation.

The software does not contact our servers during normal operation. Reinstalls are handled by email correspondence only.

7. Warranty disclaimer

Serverpacemaker is provided "as is," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software will be error-free, uninterrupted, or that it will meet your specific requirements.

8. Limitation of liability

To the maximum extent permitted by law, Job Done Marketing LLC's total liability for any claim arising from your use of Serverpacemaker shall not exceed the amount you paid for the software. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption.

9. Third-party components

Serverpacemaker is built using the Go programming language and its standard library. No third-party open-source components are included beyond the Go standard library. You can verify this by inspecting the binary.

10. Termination

This license is perpetual and cannot be terminated by us unless you materially breach these terms. If you breach them, we may terminate your license by written notice. Sections 7, 8, and 11 survive termination.

11. Governing law

These terms are governed by the laws of the State of New Mexico, United States of America, without regard to its conflict-of-law principles. Any dispute will be resolved in the courts of Bernalillo County, New Mexico.

12. Changes to these terms

We may update these terms from time to time. Material changes will be announced on the blog and will apply only to purchases made after the change date. Your existing license is governed by the terms in effect at the time of purchase.
